VOKPIT: Terms of sale and use
Articles 10, 11 and 18 already govern the use of the app. Items marked [to be completed] will be filled in before the first subscription is sold.
This English translation is provided for convenience. The French version is the only binding one.
In short.
- The app is free to use, SOS alert and crash detection included. The Motorcycle mode is a monthly or yearly subscription, with no commitment (article 3).
- It is bought only in Google Play or in the App Store, at the price they show before you buy. A first subscription may start with a 14-day free trial (article 4).
- Payment, renewal, cancellation and refunds go through the store where you subscribed. You can cancel at any time; access continues until the end of the paid period (article 5).
- Beta testers get the Motorcycle mode for free (article 7).
- Legal guarantee of conformity for the whole length of the subscription (article 8).
- A dispute: write to us, then, if needed, refer it free of charge to the consumer mediator (article 13).
1. The publisher
The VOKPIT app is published by [identity and address of the publisher, to be published before the first subscription is sold]. Contact: [contact address to come]. Further details are on the legal notice page.
In these terms, "we" means the publisher of the VOKPIT app, and "you" the person who uses it or subscribes in it.
2. Scope
These terms govern the use of the VOKPIT app, on Android and on iPhone, free or paid, and the subscriptions to its paid modes bought in Google Play or in the App Store. They are meant for consumers. A subscription is also governed by the terms of the store that sells it.
You accept articles 10 and 11 in the Android app when you first launch it, and again for each new version of these articles; the iPhone app likewise asks you to accept the "Language model" point of article 10 (article 16). Article 18 is accepted in the app before any hazard is shared. These terms remain available on this page, which the app also opens. The version that applies to a subscription is the one in force on the day you took it out; earlier versions are sent on request.
3. What is free, what is paid
VOKPIT is an app for motorcyclists, on Android and on iPhone: riding dashboard, voice assistant driven from the helmet intercom, navigation, music and safety.
- The free tier, the engine shared by every mode, needs no purchase. It keeps, among others, the SOS alert and crash detection, hazard reporting by voice or button, the intercom microphone button, the music remote and live radio, call announcements and reading texts aloud, and navigation handed over to another app (Google Maps or Waze on Android, Maps on iPhone). Its menu presents the paid modes.
- Any paid mode unlocks the features shared by the modes: starting a track, artist or playlist by name; calling by name and dictated texts; advanced intercom settings (gestures, microphone source, wake word); live ride tracking shared with your relatives and the automatic arrival message; opening a listen-together session.
- The Motorcycle mode (subscription) adds its own features: the full riding screen (speed, lean angle, G-force, statistics, weather), the ride log, its GPX export and automatic ride detection; navigation asked by voice and turn-by-turn guidance in the helmet, with pinned destinations and favourites; offline maps and tours; bend, crosswind, fog and low-sun warnings; hazard alerts while riding, shared hazards received and vigilance zones; the garage and maintenance log. The app's Store screen shows the details before you buy.
- The other announced modes (cycling, ski, hiking) are not on sale.
Compatibility and operation. Android 10 or later phone, or iPhone on iOS 17 or later, with GPS. Route computation, the base map without an offline map, live tracking, weather and activating a code need an internet connection. Helmet buttons and microphone need a Bluetooth intercom (standard hands-free and audio remote profiles). Starting a track by name needs a compatible music app installed on the phone. On Android, the helmet assistant uses the phone's speech recognition service. These third-party services work under their own terms and do not depend on us. On iPhone, some features differ (article 16).
Installation and updates. The app is installed from Google Play or the App Store, which also deliver its updates. A test version, outside Google Play, is reserved for beta testers (article 7).
4. Price and trial
The price is the one the store shows before you buy, all taxes included, in your currency; only that price is binding. As a guide, in France, the Motorcycle mode costs €4.99 per month or €44.99 per year. No fee is added, apart from the cost of your internet access.
A first subscription may start with a 14-day free trial, once only: the store decides who is eligible, and the app only announces it to an eligible account. Nothing is charged during the trial. If you do not cancel before it ends, the store charges the price of the chosen plan, then charges it again at each renewal.
A price change is announced to you by the store before it applies, under its rules; you may cancel before then, free of charge.
5. Purchase, renewal, cancellation and refunds
The subscription is bought in the app's Store, through the Google Play or App Store purchase sheet. The store collects the payment: we never receive your bank details. The contract is concluded when the store confirms the purchase, and access to the mode is immediate.
The subscription, monthly or yearly, has no minimum term. It renews at each renewal date until it is cancelled. You can cancel at any time, free of charge and without giving a reason, in the store where you subscribed (article 15 for Google Play, article 16 for the App Store) or with the "Cancel or manage my subscription" button in the Store, which opens the store's page. The mode stays active until the end of the paid period; the current period is not refunded pro rata, unless the store decides otherwise.
Refund requests go to the store, under its terms. The subscription stays tied to your Google Play or Apple account, never to your VOKPIT account: deleting that account or uninstalling the app does not cancel it, and a subscription taken in Google Play does not unlock the iPhone app, nor the other way round.
6. Right of withdrawal
A consumer generally has 14 days to withdraw from a contract concluded at a distance. For a subscription bought in Google Play or in the App Store, this right and the refund that follows are exercised with the store that collected the payment, under its terms: Google Play for a purchase in Google Play, Apple (reportaproblem.apple.com) for a purchase in the App Store. You may also write to us (article 13): we will tell you how.
During a free trial, nothing is charged: cancelling before it ends costs nothing.
7. Access offered to beta testers
During the beta, we offer the Motorcycle mode to testers. This access is free and covers the Motorcycle mode only.
- On Android, with a personal activation code, entered in the Store ("I have an activation code", or "I have a purchase code" in the test version). Activation asks you to sign in to an account once. The mode is unlocked by a signed licence, checked on the phone without a connection and tied to the device; one code activates on three devices at most. A subscription taken later in Google Play adds to it, without losing anything.
- The test version, reserved for testers, is installed from the APK file published by the publisher, outside Google Play: Android asks you to allow installs from that source. Its updates do not install themselves: the app reports a new version and opens it in your browser.
- On iPhone, through TestFlight, where purchases are not charged, or with an App Store offer code, redeemed in the App Store, which opens the subscription for free for the stated period, without automatic renewal.
Your code is personal: do not share it beyond your own devices (article 10).
8. Legal guarantee of conformity
We are liable for lack of conformity of the app and of the purchased mode for the whole length of the subscription. To claim it, write to us at [contact address to come] (article 13). We offer no commercial guarantee on top of the legal one.
The framed statement of article 8 of the French version, required by article D. 211-4 of the French consumer code, sums up your rights: you may have a lack of conformity appearing during the subscription remedied without undue delay, free of charge and without major inconvenience, including the updates needed to keep the app in conformity; failing that, or if the defect is serious enough, you may obtain a price reduction or end the contract with a full refund; the guarantee is suspended while the app is unavailable for repair; you also benefit from the guarantee against hidden defects (articles 1641 to 1649 of the French civil code) for two years from discovery of the defect.
9. Account, updates and discontinuing a mode
Account. The app asks for an account from first launch (Google or email address, and Apple on iPhone). It is used for syncing, for hazards shared between riders and for activating a code; a subscription bought in a store is not linked to it. You can delete it at any time, from the app or on the Delete your account page.
Updates. They come through the store. Those that keep the app in conformity are due for the whole length of the subscription (article 8).
Discontinuing a mode or the service. If we discontinue the Motorcycle mode or the service, we tell you in the app and by email, at your account's address, at least 30 days in advance, and we withdraw it from sale: no renewal is charged after it stops, and the part of a paid period that would not be provided is refunded to you.
10. Using the app
- Licence. We grant you a personal, non-exclusive and non-transferable right to use the app, and the purchased mode for the length of the subscription. Your code is personal: do not share it beyond your own devices.
- Road safety. Set the app up while stopped and, while riding, use voice or the intercom buttons. You alone remain responsible for your riding and for obeying traffic law. Routes, speed limits, bend alerts, vigilance zones, weather, speed, lean angle and G-force are indicative aids, computed from sensors and data (notably OpenStreetMap and MET Norway) that may be inaccurate, incomplete or unavailable. Road signs and your vehicle's instruments prevail.
- SOS. The SOS alert is not an emergency service: no assistance centre receives it. It sends texts to the contacts you chose, calls the one you designated for the call and, if you turned it on, opens the dialer on the emergency number, which you call yourself. It depends on the mobile network, GPS, battery and granted permissions, and crash detection may miss a crash or go off by mistake. In an emergency, call 112.
- Third-party services. Spotify, Google, web radios and the other services the app controls are used under their own terms.
- Language model. The app embeds a model derived from Gemma (FunctionGemma 270M), modified by us and subject to the Gemma Terms of Use (ai.google.dev/gemma/terms). You agree not to use it, or allow others to use it, in violation of applicable laws and regulations, or for any use restricted by the Gemma Prohibited Use Policy (ai.google.dev/gemma/prohibited_use_policy), including: infringing the rights of others, dangerous, illegal or malicious activities, deception or misinformation, sexually explicit content. That policy forms part of these terms; both texts are reproduced under Settings › About › Open-source licenses.
11. Liability
We are fully liable for the proper performance of the contract. We may be relieved of all or part of that liability by proving that non-performance or improper performance is attributable to you, to the unforeseeable and insurmountable act of a third party to the contract, or to force majeure (article L. 221-15 of the French consumer code). Nothing in these terms limits the rights the law gives you as a consumer.
12. Personal data
The data processed for the account, code activation and subscriptions, and your rights, are described in the privacy policy.
13. Complaints and mediation
For any complaint, write to us at [contact address to come], stating the store where you subscribed. We answer within 15 days at most.
If the dispute is not settled, you may refer it free of charge to the consumer mediator we belong to:
- [name of the mediator, to be completed before the first subscription is sold]
- Address: [postal address of the mediator, to be completed]
- Website: [website of the mediator and of its complaint form, to be completed]
The mediator can only be approached after a written complaint sent directly to us, and at the latest one year after it; it cannot examine a dispute already brought before another mediator or a court (article L. 612-2 of the French consumer code). You remain free to go to the competent court. For a dispute with a seller from another EU country, the European Consumer Centre France can help (www.europe-consommateurs.eu).
14. Governing law and courts
These terms are governed by French law. If you live in another country, you keep the protection of the mandatory rules of your country of residence. You may bring a case, at your choice, before one of the courts with territorial jurisdiction under the French code of civil procedure or before the court of the place where you lived when the contract was concluded or when the harmful event occurred (article R. 631-3 of the French consumer code).
15. Subscriptions bought in Google Play
In the version of the app installed from Google Play, the subscription is bought, paid, renewed, cancelled and, where applicable, refunded through Google Play, under Google Play's terms. Cancel it in Google Play (Payments & subscriptions › Subscriptions) or with the "Cancel or manage my subscription" button in the Store. It stays tied to your Google Play account and comes back on another Android phone signed in to the same account. For any question or defect about the app itself, write to us as explained in article 13.
16. Subscriptions bought in the App Store
In the version of the app installed from the App Store, the subscription is bought, paid, renewed, cancelled and, where applicable, refunded through Apple's App Store, under the App Store's terms. Use of this version is governed by Apple's standard licensed application end user license agreement; the warnings of article 10 on road safety, SOS and third-party services apply as well, together with its "Language model" point, which the app asks you to accept while stopped before the voice assistant uses the model. On iPhone, the SOS alert opens the Messages app with the message ready, which you send yourself, and the call to your designated contact, which the iPhone asks you to confirm. Cancel the subscription in your Apple Account settings (Settings › [your name] › Subscriptions) or with the "Cancel or manage my subscription" button in the Store; refund requests go to Apple (reportaproblem.apple.com). For any question or defect about the app itself, write to us as explained in article 13.
17. Changes to these terms
A new version of these terms applies to subscriptions taken out after it is published. For an ongoing subscription, any change is announced in the app and by email, at your account's address, at least 30 days before it applies, and you may cancel before then, free of charge, in the store. The price only changes under article 4.
A new version of articles 10 and 11 is also shown in the Android app, which asks you to accept it before you go on using the app while stopped; the SOS alert stays available without accepting it. The iPhone version likewise shows you a new version of the "Language model" point of article 10. For an ongoing subscription, it only applies once the notice above has run, and you may cancel free of charge during that notice.
18. Hazards shared between riders
In the Android app, a hazard you report (gravel, slippery road, animal, object on the road, accident) is also shown to other riders passing nearby, as long as sharing stays on in the Road hazards screen and an account is signed in. What is sent, and when, is described in the privacy policy (§5). Sharing only starts once this article has been accepted in the app, while stopped; declining it turns sharing off, without changing anything else in the app.
- Indicative information. A shared hazard is what another rider said they saw, at a given time: it may be inaccurate, already over, or missing where a hazard exists. No alert does not mean the road is safe. Like the aids of article 10, it replaces neither your attention nor road signs.
- Fixed types, nothing else. Only these five types are shared, with a position, a direction and a time: no text, no photo, no name. Potholes and hazards without a type stay on your phone. The app does not let you report any traffic check, by police or automated.
- Only report what you saw. Reporting a hazard you know to be false, or using sharing to report anything other than a road hazard, is forbidden. While riding, report by voice (article 10). A hazard placed with the intercom buttons has no type: it stays on your phone, unless you give it one of these five types within the hour, while stopped.
- Removal by riders. When the app has just announced a hazard, a rider can say it is "still there" or "gone". Two "gone" from two different riders remove it for everyone, and one is enough if it comes from its author. A "still there" extends it, never beyond four times its initial duration.
- Reporting, no longer seeing an author. On the Road hazards screen, another rider's hazard announced in the last 24 hours can be reported if it is false, over or unrelated to the road: the report counts as a "gone", and the author does not learn who made it. You can also choose to stop seeing that rider's hazards.
- Suspension. A rider whose hazards are reported by five different riders within 90 days can no longer share for 90 days, and their hazards are no longer shown. This suspension is automatic: nobody reads the reports. You can contest it by email at [contact address to come].
- Retention. To answer a court order, the publisher keeps for one year, for each published hazard, the reference of the account that published it, its type and the time, with no IP address, including after the account is deleted (privacy policy, §9).
- Automatic expiry. Each shared hazard erases itself: after 2 hours for an animal, 3 hours for an accident, 12 hours for an object or a slippery road, 7 days for gravel, and 28 days at most if it was extended.
- Turning sharing off, deleting the account. Turning sharing off stops sending and receiving at once, but does not withdraw what you already shared: it expires, or other riders remove it. Deleting one of your hazards on the Road hazards screen, with sharing on and a network, withdraws it for everyone too. Deleting your account erases the hazards you shared (privacy policy, §12).
